Welcome to Surge Grid. These Terms govern your participation in the Surge Grid alpha pilot ("Pilot"). By creating an account or connecting a device, you agree to these Terms. Please read them carefully.

1. What the Pilot is

Surge Grid is an early-stage service that connects your electric vehicle, thermostat, home battery, or other smart devices so they can participate in electricity grid programs in Texas (ERCOT). The Pilot is provided for testing and evaluation and is offered "as is," without warranties of any kind.

2. Earnings are estimates and not yet payable

Any dollar amounts, balances, or "earnings" shown in the app during the Pilot are estimated potential values for illustration only. They are not money owed to you and are not payable. Surge Grid is in the process of enrolling with grid programs and partners required to make real payments. Real payouts, if any, will only occur after that enrollment is complete and will be governed by updated terms disclosed to you at that time.

3. Connecting your devices

You may connect devices through our integration providers (such as Smartcar and Enode). You authorize Surge Grid to access device information (for example battery level, charging status, and thermostat settings) needed to operate the service. During the Pilot, device control may be simulated. You can disconnect a device or close your account at any time.

4. Your comfort and safety

The service is designed to make only small, brief adjustments during grid events and to respect limits you set. You are responsible for ensuring participation is appropriate for your household and equipment. You can opt out of any event.

5. Your responsibilities

You agree to provide accurate information, keep your login secure, use the service lawfully, and only connect devices you own or are authorized to control.

6. Limitation of liability

To the fullest extent permitted by law, Surge Grid is not liable for any indirect, incidental, or consequential damages arising from the Pilot, and our total liability is limited to the amount you paid us (which, during the Pilot, is zero).

7. Changes and termination

We may modify or discontinue the Pilot, or update these Terms, at any time. We will make reasonable efforts to notify you of material changes. Continued use after changes means you accept the updated Terms.
